General Terms and Conditions of Sale (T&Cs)
These general terms and conditions of sale (hereinafter the ‘T&Cs’) apply to all orders placed on the Simrane website (hereinafter the ‘Site’), accessible at www.simrane.com, whose registered office is located at 23 & 25, rue Bonaparte, 75006 Paris (S.A.R.L. with capital of €336,756.00, registered with the Paris Trade and Companies Registry under number B 317 287 324 00014, and whose intra-community VAT number is FR 14 317 287 324).
These General Terms and Conditions of Sale are concluded between Simrane and any natural person having the status of consumer (hereinafter the ‘Customer’), making a purchase via the Site.
1. Scope of application
These T&Cs govern the sale of products offered on the Site. By placing an order, the customer fully and unreservedly accepts these conditions.
2. Products
The products offered for sale are hand-printed Indian fabrics, including household linen (tablecloths, bedspreads, napkins, etc.), clothing and accessories. Each product is described and presented as accurately as possible. However, slight variations may occur, particularly due to the handmade characteristics of the items.
3. Prices
The prices displayed on the Site are indicated in euros, all taxes included (VAT included), excluding delivery charges. Simrane reserves the right to modify its prices at any time, but the products will be invoiced at the price in effect at the time of the order.
4. Ordering
The customer may place an order directly on the Site by selecting the desired products. Any order will be considered as accepted after validation of the payment. Simrane reserves the right to refuse or cancel an order in case of dispute, non-payment, or any other problem related to the order.
5. Payment
Orders are paid for using the payment methods available on the Site (credit card, PayPal). Payment is secured by the protocols in force. The order will be validated once payment has been received.
6. Delivery
Simrane delivers in France and internationally and offers several delivery options, including standard delivery, express delivery, and the possibility of in-store collection. Delivery by Colissimo in mainland France is free for all orders over €150. For in-store collection, a notification is sent to the customer when the order is ready for collection. There is no additional charge for this service. Delivery costs and times vary according to the destination and delivery method chosen by the customer, and are indicated before the order is validated. In the event of late delivery, Simrane cannot be held responsible for delays due to carriers.
Customs duties and/or local taxes may apply on receipt of the parcel, for any order placed from a country outside the European Union. These additional charges are payable by the customer and depend on the regulations in force in the destination country. We advise you to check with your local customs authorities before placing your order.
7. Right of withdrawal
In accordance with the law, the customer has a period of 14 days from receipt of the order to exercise his right of withdrawal, without having to justify his reasons. Products must be returned in their original, unused condition and in their original or similar packaging. Returns are free of charge from Metropolitan France and European Union countries. For countries outside the EU zone, returns are at the customer’s expense.
8. Returns and refunds
Simrane does not carry out exchanges but only refunds. In case of non-conformity or obvious manufacturing defect (excluding irregularities inherent to the manual printing process), the client may return the product within 14 days of receipt. Simrane will proceed to a refund after reception and inspection of the returned products. An exchange may be proposed for the same item. The refund will be made by the same method of payment used at the time of the order (bank account or PayPal account) and after reception and inspection of the returned product.
9. Liability
Simrane cannot be held responsible for any indirect damage that could occur during the purchase of the products. Simrane’s liability is limited to the amount of the order placed.
10. Intellectual property rights
All elements of the Site (texts, images, products, etc.) are protected by intellectual property rights. Reproduction in whole or in part is prohibited without the authorisation of Simrane.
11. Applicable law
These T&Cs are governed by French law. In the event of a dispute, the customer undertakes to contact Simrane as a matter of priority in order to find an amicable solution. Failing this, the dispute will be brought before the competent courts.
12. Online Dispute Resolution (ODR)
In accordance with European regulations, consumers may use the European Online Dispute Resolution (ODR) platform to resolve any dispute relating to an online purchase. You can access this platform via the following link: ec.europa.eu/consumers/odr.
General Terms and Conditions of Use (GTCU)
These General Terms and Conditions of Use (GTCU) govern access to and use of the Simrane website (hereinafter ‘the Site’). By accessing the Site, the user accepts without reservation these GTCU.
1. Purpose
The purpose of the GTCU is to define the terms and conditions of access to and use of the Site by all users. Access to the Site implies acceptance of these GTCU.
2. Access to the Site
The Site is accessible free of charge to any user with an internet connection. However, the costs of access (internet connection, equipment, etc.) are borne by the user. Simrane reserves the right to modify, suspend or temporarily interrupt access to the Site, in particular for maintenance reasons.
3. Intellectual property rights
All content on the Site (text, images, logos, videos, etc.) is protected by intellectual property rights held by Simrane or its partners. Any reproduction, distribution, modification or use of this content without prior authorisation is strictly prohibited.
4. Use of the Site
The user undertakes to use the Site in accordance with the laws and regulations in force. It is forbidden to use the Site for illegal purposes or in a way that may harm Simrane or third parties. The user also undertakes not to introduce viruses or any other technology likely to harm the operation of the Site.
5. Management of user accounts
The Site may offer the creation of user accounts to place orders or access specific functionalities. The user is responsible for the confidentiality of his identifiers and the use of his account. In case of unauthorized use of his account, he must immediately inform Simrane.
6. Protection of personal data
Personal information collected via the Site is processed in accordance with Simrane’s privacy policy. By using the Site, the user consents to the processing of his or her data for the purposes of order management, promotional communication, and the services offered by the Site.
7. Liability
Simrane makes every effort to ensure the accuracy of the information on the Site. However, Simrane shall not be liable for any errors, omissions or results obtained from the use of such information. Simrane cannot be held responsible for any direct or indirect damage resulting from the use of the Site, including in the event of interruption of service or technical malfunction.
8. Links to third party sites
The Site may contain links to external sites. Simrane has no control over these sites and cannot be held responsible for their content. Users access these sites at their own risk.
9. Changes to the GTCU
Simrane reserves the right to modify these GTCU at any time. The modifications come into force as soon as they are published on the Site. Users are advised to consult this page regularly to keep informed of any changes.
10. Applicable law and jurisdiction
These GTCU are governed by French law. In the event of a dispute, and after an attempt at amicable resolution, the French courts shall have sole jurisdiction.
